Settlement reached
in Medicare lawsuit
In October, a proposed settlement was reached in
a nationwide lawsuit that
challenged the Centers for
Medicare & Medicaid Services’
(CMS) practice of denying
Medicare coverage to people
unable to show improvement
after certain skilled care services.
The so-called “Improvement
Standard” particularly affected
people with chronic diseases
such as multiple sclerosis, for
whom skilled services such as
home health care and therapy are
often necessary—and expensive.
The National MS Society joined
other organizations such as
the Parkinson’s Action Network
and Paralyzed Veterans of
America as a plaintiff in the
class-action suit.
